Set-up Working Requirements
Client agrees to provide Artist with a safe and appropriate working environment. Client agrees to provide for use during the event:
- Shelter that protects the Artist from sun, wind and rain.
- Access to tap water and a restroom.
- Parking access for loading and unloading that is not farther than 60 yards (half the length of a football field) from the set-up location.
- A 6 foot by 6 foot working area that is empty.
Artist will bring her own kit with legs that serves it’s own table, as well as provide an elevated seat for the person being painted. If possible, the Artist would appreciate a location near an electrical outlet.
No Refunds if Marijuana is Being Smoked
Marijuana is now legal in some situations in the state of Ohio but it may not be smoked at events worked by this Artist. Please note there are no refunds if marijuana is being smoked. This Artist is made immediately and extremely sick from exposure to the smoke, and therefore cannot and will not stay in a location where cannabis smoke is present.
No Refunds for Bad Weather
Please note there are no refunds if entertainment services are rendered impossible by bad weather conditions. It is the responsibility of the client to provide shelter from sun, wind and rain. If the shelter provided by the customer is proving incapable of protecting the Artist and equipment from the elements, per this agreement Artist will leave and will not provide any refund. It is highly recommended, for that reason, that client has an indoor backup location.
Breaks / Overtime / Travel / Setup / Other Fees
Artist will have a paid break of 5-10 minutes every two hours and access to a restroom.
Parking fees incurred by Artist must be paid by client.
Any failed payment method will incur a fee.
Any time beyond that which was booked will be billed at a the Artist’s current per hour rate, with a full half hour charge being due for each 1-30 minutes of overtime. However, only booked times are guaranteed. Additional time on the day of the event may not be available although Artist will attempt to accommodate requests for additional paid time.
Travel fees may apply when the event is outside mapped area. Depending on your event, there may be a charge for outdoor, lengthy, or difficult setup, but please confirm with Artist prior to event by describing situation in detail.
Policies
Client acknowledges that there are risks and dangers inherent with the contracted-for entertainment, and with the props and products necessary for that entertainment. Client assumes the liability for all such risks and agrees to indemnify, defend and hold harmless the Artist from and against any and all accidents, claims, judgments, costs or liability for damage, injury to any person or property during the Event, including time of set up and take down, by guests or staff. Liability of the Artist shall not exceed the total value of this Agreement.
Under no circumstances will Artist supervise children. Their behavior and safety is the Client’s and/or Parent’s responsibility.
Artist uses only professional water activated face paints and glitters that are tested for use on the face and eye area. Brand names may include: Kraze, Fusion Body Art, TAG, Diamond FX, Professional Colors, GTX, and Superstar, to name a few. Artist does not use anything that has not been approved and tested by professional face paint artists. However, as with any cosmetics, some people may develop sensitivity to one of the ingredients. Many children are allergic to a wide range of common products. Although rare, allergic reactions to face paint can sometimes happen. The Artist is not responsible for allergic reactions. If you have concerns regarding your child’s reaction to face paints please discuss that with Artist before child is painted. Ask for a patch test 1/2 hours in advance. If irritation seems to be occurring, remove face paint immediately, otherwise remove before bedtime. Don’t sleep in face paint as it may cause irritation and/or transfer to bedsheets and blankets. To remove face paint from skin, use a soft washcloth with mild face soap (no-tears baby soap is a good choice) and warm water. If color persists, use coconut oil or kitchen vegetable oil worked gently into the skin to help remove the pigment. Do not use alcohol, mineral oil, harsh makeup removers, or strong soaps, which can irritate skin.
The Artist will use reasonable care but is not responsible for damage to clothing or property. Clothing that has been in contact with face paint should be soaked in cold water overnight with an oxygen activated stain remover before washing as indicated on the care label. Avoid placing stained clothing in the drier which will set the stain. Hang it to dry and check the stain to see if it remains. If so, repeat stain removal process.
Artist will not paint anyone under duress or who does not wish to be painted. Artist will not paint anyone, whom, in the Artist’s opinion, appears to be suffering from cold sores, conjunctivitis, any infectious skin complaint, open wounds in the area to be painted, scabbed wounds in the area to be painted, running nose that has not been cleaned from the face, dirt or encrustation on the area to be painted, anyone who appears to have head lice, or anyone who is coughing, sneezing and appears to be ill with a contagious condition. These requirements are for the safety of all being painted and to avoid the spread of communicable conditions.
Extreme Adverse Working Conditions
Artist has the right to cease painting and leave without refunding any money if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to the client’s attention. Adverse conditions include but are not limited to: destructive, violent, or extreme inappropriate behavior of a child, pet or adult, illegal activities; or otherwise dangerous conditions.
Bounce House Cautions
If you plan to have a bounce house at your event please discuss face painting with the bounce house company prior to hiring the Artist. Please be aware that some bounce house companies do not allow face painting at the events where their equipment is used. If the Artist is asked to leave due to a bounce house company policy the Artist will not refund any portion of the booking fee or event fee. If a bounce house is present at the event, the client alone is responsible for cleaning any face paint off the bounce house material and/or paying the bounce house company for such cleaning and/or for any staining of bounce house material that may occur.
Cancellation by the Artist
Should the Artist have to cancel (due to illness, or emergency, or any other unforeseen and uncontrollable circumstance) the entire fee, including the generally non-refundable booking fee, will be refunded to client.
General
This contract does not go into effect until booking fee (or show-up fee, depending on event type) has been received by Artist to secure date; all dates and times are agreed upon by both parties.
This Agreement shall be governed by, venued in, and construed in accordance with the laws of the State of Ohio. This Agreement constitutes the entire agreement between the Artist and Client and supersedes any prior written or oral communications. If any portion of this Agreement is deemed invalid, the remainder of the Agreement will remain in full force and effect. However, Client may authorize additional time and additional fees and expenses orally at or before the Event.
